Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.


This agreement is the only form of contract between the parties and any customers terms and conditions will not apply unless expressly agreed in writing. By submitting an order, the customer agrees to apply to the terms and conditions of this agreement in priority over any other agreement between the parties. Any order is subject to acceptance by Gilmartins and we are not obliged to accept any order or justify refusal of the same. Receipt of payment for goods does not constitute acceptance of the order. If any goods are out of stock then Gilmartins may cancel in whole or in part the order and refund any monies paid or issue a credit note with the customer’s approval. A customer placing an order for goods confirm they are over 18 years of age and that delivery will be accepted by a person over 18 years of age.

Goods are payable at the price listed on All prices listed are in Euro and are shown both including and excluding Irish VAT. Gilmartins reserve the right to update prices on our website from time to time. Prices listed online may differ from prices advertised in Gilmartins printed catalogues and we are under no obligation to honour the printed price while ordering online at

Payment for the order and delivery must be paid for by the options available on Gilmartins website, unless the client has a prior credit account agreement with Gilmartins and these terms and conditions are adhered to.


All shipping/delivery charges are calculated based on the total weight of your order, the rates are listed on and are subject to change from time to time. No liability will attach to Gilmartins if the delivery period is not met, please advise us of any non-delivery within 10 working days. Any shortages or damages must be reported to us in writing within 3 days of receipt. All large machinery/equipment are delivered to the front door or ground floor location.


As per EU law the customer has the right to cancel their order without a reason within 14 working days of receiving the goods. The customer may be entitled to a refund or exchange and should contact the offices of Gilmartins direct on 094 9381210 to arrange the return of the goods. The customer will be responsible for the cost of returning the goods to our warehouse, and all goods returned must be in their original packaging.

Goods that are damaged due to delivery must be reported straight away and marked on the delivery docket as damaged upon receipt of delivery.

If an item is defective please contact us immediately to arrange return, refund or exchange no later than 7 days from receipt of goods. Damaged or defective goods will be returned at no cost to the client.


All electrical goods have a one year warranty from date of delivery unless otherwise stated. Some manufacturer’s warranty does not cover full parts and labour in the Republic of Ireland. Goods reported faulty within the specified warranty period may be repaired, replaced or exchanged at Gilmartins discretion upon return to us, and only applies to customers resident in the Republic of Ireland.

Gilmartins shall be under no liability if the defect or failure of a product, in the reasonable opinion of ourselves, is caused by damage, misuse, negligence or failure to adhere to the manufacturer’s instructions per storage, cleaning and usage, by the customer or a third party.


Gilmartins shall not be liable to the customer, or deemed to be in breach of any contract with the customer, by reason of any delay in performing, or failure to perform, any of the company’s obligations in relation to the goods, if the delay or failure was due to force majeure or to any other cause beyond the company’s reasonable control.


Nothing in our terms and conditions will exclude or limit our liability to you for fraud, death or personal injury or any other liability which Irish law states may not be excluded or limited. We will not be liable to you the customer for any damages including but not limited to direct, incidental, punitive or consequential damages including those resulting from lost profits, lost data or business arising out of the goods purchased on this website. This agreement between both parties is governed by the laws of the Republic of Ireland and the jurisdiction of the Irish courts.


Gilmartins reserve the right to restrict or deny access to this site to any user, including those that have previously had access. Furthermore, Gilmartins may terminate the services provided by this site with or without cause at any time and effective immediately.


Customer’s Data Protection and Privacy rights are set out in our Privacy Policy and are available on this website. We do not purchase or share and customer information with any third party sources. Any changes to our Privacy Policy will be posted on our website and anywhere we deem appropriate so our clients are always aware of what information we collect, how we use it in accordance with our Privacy Policy and current Data Protection Law.
